Would a surfacing Bismark capsizing an opponent be counted as a ram sink?

I think that an active recovery assist system would need to have a circuit on the transmitter that sounded a buzzer/siren and flashed a bright red LED when activated. Not that' I'd use it to avoid a sink, but to prevent accusations of such behavior
